These Terms of Service ("Terms") govern your access to and use of dalbia.com and any purchase from DALBIA. DALBIA is a trading name operated by FLUXEON GLOBAL CO., LIMITED ("DALBIA," "we," "us," or "our").

By visiting the website, creating an account, submitting an order, or otherwise using our services (collectively, the "Services"), you agree to these Terms and to the policies referenced in them. If you do not agree, do not use the Services.

1. Eligibility and customer information

You must be legally capable of entering into a binding contract in your place of residence. If you are under the age of majority, you may use the Services only with the involvement and consent of a parent or legal guardian.

You agree to provide current, complete, and accurate billing, shipping, contact, and payment information. You are responsible for activity under your account and for keeping login credentials confidential.

2. Products and product information

We sell jewelry, including sterling silver pendants, earrings, rings, chains, and related accessories. We make reasonable efforts to display product colors, finishes, dimensions, and images accurately, but screens, lighting, photography, hand-finishing, and material variation may affect appearance.

Oxidized and vintage-style jewelry intentionally contains darkened areas, tonal variation, texture, and patina. These features may vary slightly between pieces. Sterling silver naturally tarnishes through exposure to air, moisture, cosmetics, sweat, chemicals, and storage conditions. Natural tarnish and ordinary wear are not necessarily product defects.

Product dimensions and weights may have reasonable measurement tolerances. Ring fit can vary by design, band width, finger shape, temperature, and measuring method. Size guides are informational and customers remain responsible for selecting the correct variant.

Unless the product page expressly says otherwise, a pendant may be sold without a chain. Where chain options are offered, the option selected and shown at checkout determines what is included.

We do not claim that any product is hypoallergenic, nickel-free, therapeutic, or suitable for a particular medical condition unless that claim is expressly stated on the relevant product page and supported by product documentation. Jewelry is not medical advice or treatment. Small jewelry pieces can present a choking hazard and should be kept away from young children.

3. Availability and order acceptance

Products and quantities are subject to availability. Placing an order is an offer to buy. An automated order confirmation acknowledges receipt but does not necessarily mean we have accepted the order.

We may accept, reject, limit, or cancel an order before shipment for reasons including stock errors, pricing or description errors, suspected fraud, payment problems, shipping restrictions, legal or compliance concerns, or unusually large/reseller quantities. If we cancel a paid order, we will refund the canceled amount to the original payment method.

4. Prices, taxes, and payment

Prices are shown in the currency displayed at checkout and may change without notice. The price charged is the price shown when the order is submitted, subject to correction of obvious errors and applicable law.

Shipping charges, taxes, duties, and other charges are displayed or described at checkout where available. For international deliveries, the recipient may be responsible for import duties, taxes, brokerage fees, or customs charges that are not collected by us. Currency conversion and foreign transaction fees are determined by your bank or payment provider.

You represent that you are authorized to use the payment method submitted. We may use third-party payment and fraud-screening services and may request additional verification before accepting or shipping an order.

Discount codes and promotions are subject to their stated conditions, availability, and expiration. Unless expressly allowed, promotions cannot be combined, exchanged for cash, or applied retroactively.

5. Shipping, delivery, returns, and refunds

Shipping and delivery are governed by our Shipping Policy. Returns, cancellations, exchanges, and refunds are governed by our Refund Policy. Those policies form part of these Terms.

Delivery dates are estimates unless expressly guaranteed. Risk and title pass as provided by applicable law. You are responsible for providing an accurate address and for monitoring tracking and delivery notices.

6. Jewelry care and use

Follow the care guidance provided with the product or on the website. Avoid exposing jewelry to pools, seawater, household cleaners, perfume, lotion, hairspray, excessive moisture, and impact. Store pieces separately in a dry place. Improper wear, storage, cleaning, modification, or repair by another party may damage the product and may affect remedies that are not required by law.

7. Accounts, reviews, and user content

If account features are available, you are responsible for maintaining account security and notifying us of suspected unauthorized use.

If you submit a review, photo, comment, idea, or other content, you retain ownership of your content but grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, display, adapt, and use it in connection with operating, promoting, and improving DALBIA and the Services. You represent that you have the right to submit the content and that it is truthful, lawful, and does not violate another person's rights. We may remove content that violates these Terms or applicable law.

8. Intellectual property

The DALBIA name, logo, website design, text, graphics, product presentation, photographs owned by us, and other content are protected by intellectual-property laws. Except for personal, non-commercial viewing of the Services, no content may be copied, reproduced, distributed, modified, scraped, published, or commercially used without prior written permission from the applicable rights holder.

Third-party names, marks, and content remain the property of their respective owners.

9. Prohibited uses

You must not use the Services to:

• violate law or another person's rights;

• submit false, misleading, fraudulent, or harmful information;

• interfere with security, access controls, or operation of the Services;

• introduce malware, malicious code, or automated traffic that imposes an unreasonable load;

• scrape, harvest, reverse engineer, or reproduce the Services except where law expressly permits;

• impersonate another person or misuse payment information;

• resell products in a manner that misrepresents affiliation with or authorization by DALBIA; or

• engage in fraudulent returns, chargeback abuse, or other misuse.

We may suspend or terminate access for violations.

10. Third-party services and links

The Services may rely on or link to third-party services, including Shopify, payment providers, social media, delivery carriers, and apps. Third-party services are governed by their own terms and policies. We are not responsible for third-party websites or services except to the extent required by law.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Services are provided on an "as available" basis. We do not guarantee that the website will always be uninterrupted, error-free, secure, or compatible with every device. Product warranties and consumer guarantees are limited to those expressly stated by us and those that cannot be excluded under applicable law.

Nothing in these Terms excludes any statutory warranty, guarantee, or remedy that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by law, FLUXEON GLOBAL CO., LIMITED, DALBIA, and our directors, officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profit, revenue, data, or business opportunity arising from the Services or products.

Where liability may lawfully be limited, our aggregate liability arising from a product or order will not exceed the amount paid for the affected product or order.

These limitations do not apply to fraud, fraudulent misrepresentation, willful misconduct, death or personal injury caused by negligence where liability cannot be limited, or any consumer right or other liability that applicable law does not allow us to exclude or limit.

13. Indemnity

To the extent permitted by law, you agree to indemnify FLUXEON GLOBAL CO., LIMITED against third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights. This section does not apply to the extent a claim was caused by us or where such an obligation cannot legally be imposed on a consumer.

14. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using the Services, you acknowledge that information may be processed by Shopify and other providers needed to operate the store and fulfill orders.

15. Changes to the Services or Terms

We may update the Services and these Terms from time to time. Updated Terms will be posted with a new "Last updated" date. Changes apply prospectively unless law requires otherwise. The Terms in effect when an order is placed will generally govern that order.

16. Suspension and termination

We may suspend or terminate access to the Services if you materially violate these Terms, misuse the Services, create security or legal risk, or engage in fraud. Provisions that by their nature should survive termination will remain in effect.

17. Severability and no waiver

If a provision is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver.

18. Entire agreement

These Terms, together with the policies and order information referenced here, constitute the agreement between you and us regarding the Services and purchases, except for terms that applicable law automatically includes.

19. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules. The courts of Hong Kong will have non-exclusive jurisdiction, except where mandatory consumer law gives you the right to bring a claim in another jurisdiction or requires another law or forum to apply.
